PilatesCRM

Terms

Effective October 15, 2026. Fig Technologies LLC, a Delaware limited liability company. The business is run from Davidson, North Carolina.

These Terms of Service (“Terms”) are a binding agreement between you and Fig Technologies LLC (“Fig Technologies,” “we,” “us,” or “our”), governing your access to and use of PilatesCRM at https://pilatescrm.com and related pages, forms, and services (together, the “Services”). By accessing or using the Services, submitting a form, creating an account, or making a purchase, you agree to these Terms and to our Privacy Policy and Cookie Notice. If you do not agree, do not use the Services. If you use the Services on behalf of a business, you represent that you have authority to bind that business, and “you” includes that business.

Please read the section titled “Dispute resolution; binding arbitration; class-action waiver” carefully. It requires most disputes to be resolved by individual arbitration and waives jury trials and class actions.

1. Eligibility

You must be at least 18 years old (and the age of majority where you live) to use the Services, or use them with the involvement of a parent or guardian who agrees to these Terms. The Services are not directed to, and may not be used by, children under 13. You represent that you are not barred from using the Services under applicable law, including U.S. sanctions laws.

2. The Services

PilatesCRM is multi-tenant software for Pilates and fitness studios. Depending on the plan, features may include class and appointment booking, schedules and waitlists, memberships and class packs, payments through Stripe Connect and Square, automated SMS and email, AI features, and booking widgets a studio embeds on a site it already has. Part 1A of these Terms applies to studios. People who book through a studio are governed by the End Client Terms, which incorporate the protective sections of Part 1A listed there. Features vary by plan and may change over time. PilatesCRM does not host a marketing website for a studio and does not publish a native mobile app.

3. Definitions

“Studio” or “Customer” means the business that subscribes to PilatesCRM. “End Client” means a person who books, buys, or interacts with a Studio through PilatesCRM (for example, through a booking page or a widget on the Studio’s own website). “Studio Data” means data that a Studio or its End Clients submit to PilatesCRM, including End Client personal information. “Order” means the plan, pricing page, checkout, or order form through which a Studio subscribes.

4. Subscriptions, billing, automatic renewal, and no refunds

Studios pay the subscription fees for the plan selected in the Order, plus applicable taxes and any usage-based charges stated in the Order (such as SMS above plan limits). Subscription fees are billed in advance through Stripe.

Your subscription automatically renews at the end of each billing period (monthly or annual, as selected) for the same period at the then-current rate, and you authorize us to charge your payment method on file at each renewal until you cancel. You may cancel at any time in account settings or by emailing rob@figtech.xyz. Cancellation takes effect at the end of the current billing period. We will give at least 30 days’ notice of price increases, which apply from your next renewal.

Fees are non-refundable and non-cancellable once charged. We do not provide refunds or credits for partial billing periods, unused features, downgrades, or periods in which you did not use the Services, except where required by law.

If a payment fails or is overdue, we may retry the charge, limit access after notice, and recover reasonable collection costs. You are responsible for all taxes other than taxes on our net income.

Studios accept End Client payments through Stripe Connect or Square and must accept that processor’s terms, including, for Stripe, the Stripe Connected Account Agreement. The processor handles card data directly. Neither PilatesCRM nor Fig Technologies stores full card numbers. The Studio is the merchant of record for End Client purchases and is solely responsible for its prices, refunds, chargebacks, disputes, taxes, and processor fees. We are not a party to transactions between a Studio and its End Clients.

5. Studio Data: ownership and our role as processor

As between the parties, the Studio owns all Studio Data. The Studio grants us a non-exclusive license to host, process, transmit, and display Studio Data solely to provide, secure, support, and improve the Services, as instructed by the Studio and described in these Terms. We may create and use de-identified, aggregated data that does not identify the Studio or any individual.

For End Client personal information in Studio Data, the Studio is the controller (or “business”) and we are the Studio’s processor (or “service provider”). The Studio is responsible for having a lawful basis, providing required notices, and obtaining consents needed for us to process Studio Data, including a privacy policy that discloses its use of PilatesCRM.

During the subscription, a Studio may export its Studio Data using available tools. After termination, we will make Studio Data available for export for 30 days on request and may then delete it, except copies held in backups (overwritten on our ordinary backup cycle) or retained as the law requires.

PilatesCRM is not designed for, and does not comply with, HIPAA or other laws governing protected health information. Studios must not store medical records or more health information than necessary (for example, a brief injury note an instructor needs), and they are responsible for that information.

6. Data processing addendum

This section is our data processing addendum with each Studio and applies to our processing of End Client personal information on the Studio’s behalf.

  1. We process Studio personal data only to provide the Services and on the Studio’s documented instructions (these Terms and the Studio’s configuration are its instructions), unless the law requires otherwise, in which case we will inform the Studio where legally permitted.
  2. Processing includes hosting, storage, scheduling, payment facilitation, messaging, and AI features. Data subjects are End Clients, Studio staff, and prospects. Data categories include contact details, booking and attendance history, membership and purchase records, payment metadata (card brand, last four digits, and processor identifiers, never full card numbers), waiver and consent records, communications, and notes the Studio enters.
  3. Personnel with access to personal data are bound by confidentiality obligations.
  4. We maintain reasonable technical and organizational measures, including encryption in transit, access controls, least-privilege access, logical separation of tenant data, and backups.
  5. The Studio authorizes the subprocessors listed in the Privacy Policy. We impose data-protection terms on subprocessors that are substantially as protective as this addendum, and we give notice of new subprocessors by updating that list. A Studio may object on reasonable data-protection grounds within 15 days. If we cannot resolve the objection, the Studio’s sole remedy is to terminate the affected Services.
  6. Taking into account the nature of processing, we will provide reasonable assistance (including self-service tools) with data subject requests, security, and legally required assessments. We will forward End Client requests we receive to the Studio.
  7. We will notify the Studio without undue delay after confirming a security breach affecting Studio personal data, with the information reasonably available to help the Studio meet its obligations.
  8. We will not sell or share Studio personal data; retain, use, or disclose it outside our direct business relationship with the Studio or for any purpose other than the business purposes in these Terms; or combine it with personal information from other sources, except as the law permits.
  9. Data is processed in the United States. Where a Studio’s End Clients are in the EEA, UK, or Switzerland, the parties incorporate the EU Standard Contractual Clauses (Module 2 or 3, as applicable) and the UK Addendum by reference.
  10. On termination, we return or delete personal data as described above. On reasonable written request (no more than once a year), we will provide information reasonably necessary to demonstrate compliance with this addendum.

Our liability under this addendum is subject to the limitation of liability in these Terms.

7. Waivers, messaging consent, and studio policies

Each Studio is solely responsible for its classes, instructors, facilities, safety, insurance, and licenses, and for drafting, presenting, and enforcing its own liability waivers and its cancellation, membership, and refund policies. PilatesCRM may provide tools to display and record e-signatures on waivers. We do not draft waivers, do not give legal advice, and do not guarantee that any waiver or policy is enforceable.

PilatesCRM can send automated SMS and email for the Studio (for example, booking confirmations, reminders, waitlist alerts, and win-back messages). The Studio is the sender. You are solely responsible for complying with laws that apply to messages you send, or that are sent on your behalf, including the Telephone Consumer Protection Act, state telemarketing laws, the CAN-SPAM Act, Do-Not-Call rules, wireless-carrier and 10DLC requirements, and international laws such as CASL and the GDPR and ePrivacy rules. This includes obtaining and documenting required consent before sending marketing texts or emails, honoring STOP and unsubscribe requests promptly, including required sender identification, and observing quiet hours. We do not obtain consent on your behalf and do not review your contact lists. The Studio must send messages only to recipients who have given the required consent and must not upload purchased, rented, or scraped lists. The Studio will indemnify us for claims, fines, or carrier penalties arising from its messages or contact lists.

8. AI features

Some features use artificial intelligence, including third-party models reached through the Vercel AI Gateway. AI output can be inaccurate, incomplete, biased, or inappropriate, may resemble content generated for others, and is not professional (including legal, financial, medical, or tax) advice. You are solely responsible for reviewing AI output before you use, publish, or send it, and for decisions based on it. We do not guarantee any particular outcome. Do not submit information you do not have the right to share.

AI features (such as setup drafting, insights, and message suggestions) are decision-support tools. The Studio decides whether to act on them and is responsible for the messages and decisions it approves. We do not use Studio Data to train third-party foundation models. Requests sent to OpenAI through the Vercel AI Gateway use zero data retention and are not used to train those models. We may change, limit, or remove AI features at any time.

9. Widgets and studio branding

Studios may embed PilatesCRM booking and purchase widgets on their own websites. The Studio is responsible for its website, must link to the End Client Terms and the Privacy Policy wherever End Clients book or pay, and must not modify widgets to remove required notices.

The Studio grants us a limited license to display its names and logos to provide the Services and, unless it opts out by email, to identify it as a customer.

10. Availability and support

We aim to keep PilatesCRM available and to perform maintenance at low-traffic times. We do not guarantee any level of uptime, and there is no service-level agreement or service credit unless a signed Order includes one. The Services depend on third parties (including hosting, the database, Stripe, Square, SMS, email, and AI providers) whose outages are outside our control. The Studio is responsible for keeping its own records of critical information (such as class rosters) for business continuity. We provide support by email on a commercially reasonable basis.

11. Accounts

You are responsible for providing accurate information, keeping your credentials secure, and all activity under your account. Notify us promptly at rob@figtech.xyz of any unauthorized use. We are not liable for losses caused by unauthorized use of your credentials.

12. Acceptable use

You agree not to, and not to help anyone else to:

  • violate any law, regulation, or third-party right;
  • submit false, misleading, infringing, defamatory, obscene, or harassing content, or content you do not have the right to submit;
  • upload malware or attempt to probe, scan, disrupt, overload, or gain unauthorized access to the Services, accounts, or systems;
  • scrape, crawl, harvest, or bulk-download content or data, or use the Services to build a competing product, except as we expressly permit;
  • reverse engineer, decompile, or attempt to extract source code, except to the extent this restriction is prohibited by law;
  • submit spam, unsolicited bulk messages, or automated form submissions;
  • impersonate any person or misrepresent your affiliation;
  • remove or obscure proprietary notices, or circumvent security, rate limits, or access controls;
  • send messages without legally required consent, or upload purchased, rented, or scraped contact lists;
  • store payment card numbers, government IDs, or medical records in notes, custom fields, or messages; or
  • resell, sublicense, or provide access to the Services to anyone other than your staff and End Clients.

We may investigate violations, remove content, suspend or terminate access, and cooperate with law enforcement, at our discretion and without liability to you.

13. Intellectual property

The Services, including software, code, designs, text, graphics, templates, logos, and the PilatesCRM name and marks, are owned by Fig Technologies or its licensors and are protected by copyright, trademark, and other laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for their intended purpose. All rights not expressly granted are reserved. Studios own their Studio Data as described above.

14. Your content

You retain ownership of information and content you submit (“Your Content”). You grant Fig Technologies a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, and display Your Content solely to operate, provide, secure, and improve the Services and to respond to you. You represent that you have all rights necessary to submit Your Content and that it does not violate these Terms or any law. Unless we have signed a separate written confidentiality agreement, information you submit through contact forms is not treated as confidential. If you send us ideas or feedback, we may use them without restriction or compensation.

15. Third-party services

The Services may link to or integrate third-party websites, products, and services (for example, Stripe, Square, and other processors). We do not control and are not responsible for third-party services, content, availability, or practices, and your use of them is governed by their own terms and policies.

16. Orders, pricing, and payment

Where the Services offer paid products, you agree to pay all charges at the prices in effect when you order, plus applicable taxes. Subscription payments are processed by Stripe. End Client payments are processed by Stripe or Square. We do not receive or store full payment card numbers. You authorize us and our payment processor to charge your selected payment method for subscription fees. We may correct pricing errors and refuse or cancel orders (including suspected fraud). If we cancel a paid subscription order, we will refund amounts charged for it. Prices, products, and features may change at any time, with the notice described in the subscription section for renewal prices.

17. Privacy

Our Privacy Policy and Cookie Notice describe how we handle personal information and are part of these Terms.

18. Disclaimer of warranties

The Services and all content and outputs are provided “as is” and “as available,” with all faults. To the fullest extent permitted by law, Fig Technologies disclaims all warranties, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and quiet enjoyment, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Services will be uninterrupted, timely, secure, error-free, or free of harmful components, or that any information or result will be accurate or reliable. You use the Services at your own risk. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

19. Limitation of liability

To the fullest extent permitted by law: (1) Fig Technologies and its owners, members, managers, employees, contractors, agents, licensors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or use, or cost of substitute goods or services, arising out of or relating to the Services or these Terms, however caused and under any theory of liability, even if advised of the possibility of such damages; and (2) our total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the fees paid or payable by the Studio to us for the Services in the 12 months before the event giving rise to the claim (or, for End Clients and free users, US $100). We are not liable for Studio services, injuries at or related to a Studio, messages sent by or for a Studio, payment disputes between Studios and End Clients, or loss of Studio Data beyond our obligation to use commercially reasonable efforts to restore it from available backups. These limitations are an essential basis of the bargain and apply even if a remedy fails of its essential purpose. They do not limit liability that cannot be limited under applicable law.

20. Indemnification

You will defend, indemnify, and hold harmless Fig Technologies and its owners, members, managers, employees, contractors, and agents from and against any claims, damages, liabilities, penalties, fines, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use or misuse of the Services; (b) Your Content; (c) your violation of these Terms or any law or third-party right; and (d) for Studios, Studio Data, the Studio’s classes, facilities, instructors, waivers, policies, and End Client relationships, and any message sent by or for the Studio, including TCPA, CAN-SPAM, Do-Not-Call, and carrier claims. We may assume exclusive control of any matter subject to indemnification, and you will cooperate. You may not settle any matter without our prior written consent.

21. Suspension and termination

We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Services at any time. Studios may cancel as described in the subscription section. We may terminate a Studio’s subscription for convenience on 30 days’ notice (refunding prepaid fees for any remaining full months) or immediately for non-payment, material breach, or legal risk. On termination, your right to use the Services ends. Sections that by their nature should survive (including ownership, licenses you grant us, payment obligations, disclaimers, limitation of liability, indemnity, and dispute resolution) survive termination. We may modify, suspend, or discontinue the Services or any feature at any time without liability, subject to the subscription notice rules above.

22. Changes to these Terms

We may change these Terms from time to time. We will post the updated Terms with a new effective date and, for material changes, may provide additional notice (such as by email or an in-product notice). Changes take effect when posted unless we state otherwise. Changes to the dispute-resolution section do not apply to disputes of which we had actual notice before the change. Your continued use after changes take effect means you accept them. If you do not agree, stop using the Services. Creating a studio records the Terms version you accepted.

23. Dispute resolution; binding arbitration; class-action waiver

Before starting any arbitration or court proceeding, you and we agree to try to resolve the dispute informally for at least 30 days after one party sends the other a written notice describing the claim and the relief sought. Send notices to Fig Technologies LLC, Davidson, North Carolina, at rob@figtech.xyz.

Except as provided below, any dispute arising out of or relating to these Terms or the Services (including the formation, scope, enforceability, or validity of this arbitration agreement) will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (for individuals acting for personal purposes) or its Commercial Arbitration Rules (for businesses), as modified by these Terms. The Federal Arbitration Act governs this section. Arbitration will take place in Mecklenburg County, North Carolina, or by video or written submissions, unless the arbitrator orders otherwise. An individual consumer may elect to arbitrate in the county where they reside. Fees are allocated under the applicable rules. The arbitrator may award the same individual relief a court could, but only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim.

You and we each agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding, and you and we each waive the right to a jury trial. The arbitrator may not consolidate claims of more than one person. If this class-action waiver is found unenforceable as to a claim, that claim (and only that claim) must be severed and heard in court, stayed pending the outcome of any arbitrable claims.

Either party may bring an individual claim in small-claims court if it qualifies and stays there, and may seek injunctive or other equitable relief in court to protect intellectual property, confidential information, or the security of the Services.

You may opt out of this arbitration agreement by emailing rob@figtech.xyz within 30 days after you first accept these Terms, with your name, contact information, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

To the extent permitted by law, any claim must be filed within one year after it arises, or it is permanently barred.

24. Governing law and venue

These Terms and any dispute arising from them or the Services are governed by the laws of the State of North Carolina and applicable U.S. federal law, without regard to conflict-of-laws rules. The U.N. Convention on Contracts for the International Sale of Goods does not apply. For any matter not subject to arbitration, you and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Mecklenburg County, North Carolina.

25. General

These Terms (with any order form or policy expressly incorporated by reference) are the entire agreement between you and us about their subject and supersede prior understandings. If any provision is held unenforceable, it will be enforced to the maximum extent permissible and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them freely, including in a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. You consent to receive communications from us electronically, and electronic notices satisfy any writing requirement. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship. Headings are for convenience only, and “including” means “including without limitation.”

End Client Terms

These End Client Terms apply when you book a class, buy a membership or class pack, sign a waiver, or receive messages from a Pilates or fitness studio (the “Studio”) through PilatesCRM, operated by Fig Technologies LLC.

  1. The Studio is your provider. PilatesCRM is software the Studio uses. Your classes, memberships, packages, prices, cancellations, late-cancel and no-show fees, refunds, waivers, and in-studio rules are provided by the Studio and governed by the Studio’s own policies. Send questions, refund requests, and complaints about classes to the Studio.
  2. Payments. Stripe or Square processes payments on the Studio’s behalf, and the Studio is the merchant. We never receive or store your full card number. If you save a card or buy a recurring membership, you authorize the Studio (through its processor) to charge it under the Studio’s terms until you cancel under those terms.
  3. Messages. If you give your phone number and consent, the Studio may send you texts and emails through PilatesCRM about bookings and, if you agree, promotions. Message frequency varies, and message and data rates may apply. Reply STOP to opt out of texts or HELP for help, and use the unsubscribe link in emails. Consent to marketing is not a condition of purchase.
  4. Fitness risk. Exercise involves risk of injury. Consult a physician before starting, follow instructor directions, and work within your limits. Fig Technologies does not provide fitness services and is not responsible for injuries, classes, facilities, or instructors. You may be asked to sign the Studio’s waiver, which is between you and the Studio.
  5. Your data. The Studio controls the personal information you give it through PilatesCRM, and we process it for the Studio as its service provider. Contact the Studio first to access, correct, or delete your information. See the Privacy Policy.
  6. Age. You must be at least 18, or at least 13 with a parent or guardian’s consent and the Studio’s permission. Children under 13 may not create accounts. Where the Studio allows, a parent or guardian must book for them.
  7. Protective terms that also apply to you. The sections titled Acceptable use, Intellectual property, Disclaimer of warranties, Limitation of liability (our total liability to you will not exceed US $100), Indemnification, Changes to these Terms, Dispute resolution; binding arbitration; class-action waiver (including the small-claims carve-out and 30-day opt-out), Governing law and venue (North Carolina, Mecklenburg County), and General apply to your use of PilatesCRM, with “you” meaning you as an End Client. These terms do not affect any rights you have against the Studio.
